Mueller Recommends Flynn No Jail Time for Substantial Assistance on Probe

In a redacted addendum to the memorandum, Mueller's office said Flynn provided firsthand information about the content and context of interactions between Trump's transition team and Russian government officials.

It seems that Flynn is cooperating in at least three ongoing investigations: a criminal investigation about which all details are redacted; Mueller's investigation into "any links or coordination between the Russian government and individuals associated with the campaign of President Donald J. Trump"; and at least one additional investigation about which all information is redacted. Flynn was under investigation by the Justice Department for the work when he became national security adviser.

But Flynn could be well-positioned to avoid their fate. "Given the defendant's substantial assistance and other considerations set forth below, a sentence at the low end of the guideline range - including a sentence that does not impose a term of incarceration- is appropriate and warranted". Mueller's sentencing recommendation is the first of an expected troika of sentencing documents scheduled to be filed this week pertaining to Flynn, Paul Manafort and Michael Cohen.

"His early cooperation was particularly valuable because he was one of the first people with long-term and firsthand insight regarding events and issues under investigation", the memo states.

Mueller also wrote that Flynn provided documents and communications to back his oral testimony.

That was the period in which Flynn repeatedly had secret phone discussions with Russian ambassador Sergei Kislyak that he later lied about, which led to his early expulsion from the White House and then to charges he lied to Mueller's investigators.

Of the 13 pages Mueller penned and filed late Tuesday, nearly half was redacted.

GOP Rep. Matt Gaetz of Florida said Mueller's lenient sentencing recommendation reflected a double standard compared to when Trump allegedly urged former FBI Director James B. Comey to "see your way clear to letting this go, to letting Flynn go" because "he is a good guy".

Mueller's team is reportedly trying to determine whether Stone and other Trump associates had advance knowledge of WikiLeaks' plans.
